Udostępnienie informacji jest bezpłatne, chyba że jego udostępnienie jest związane z poniesieniem dodatkowych kosztów – wówczas wnioskodawca ponosi opłaty w wysokości ustalonej zgodnie z Zarządzeniem Nr 139/2016 Marszałka Województwa Opolskiego z dnia 22 grudnia 2016 r. w sprawie regulaminu udostępniania informacji publicznej w Urzędzie Marszałkowskim Województwa Opolskiego

Tryb odwoławczy:

Od decyzji odmawiającej udostępnienia informacji publicznej przysługuje stronie prawo wniesienia odwołania do Samorządowego Kolegium Odwoławczego (adres: 45-052 Opole, ul. Oleska 19), w terminie 14 dni od daty jej otrzymania. Odwołanie składa się za pośrednictwem organu, który wydał decyzję (tj. za pośrednictwem Marszałka Województwa Opolskiego).

Organ właściwy:Marszałek Województwa – decyzja administracyjna o odmowie udostępnienia informacji publicznej oraz o umorzeniu postępowania w sprawie udostępnienia informacji publicznej.
Pozytywne rozpatrzenie wniosku tj. udostępnienie informacji publicznej jest czynnością materialno-techniczną i nie wymaga wydania decyzji.

  1. Ustawa z dnia 6 września 2001 r. o dostępie do informacji publicznej (Dz. U. z 2019 r. poz. 1429 t.j.)
  2. Zarządzenie Nr 139/2016 Marszałka Województwa Opolskiego z dnia 22 grudnia 2016r. w sprawie regulaminu udostępniania informacji publicznej w Urzędzie Marszałkowskim Województwa Opolskiego.
